Terms of Service

The basics
These terms are a contract between you and The IT Dept Pty Ltd (ABN 12 665 405 505), the company behind nark.dev. By using nark, you agree to these terms. If you don't agree, don't use the service. Pretty simple.
What nark does
Nark is an uptime monitoring service. We check if your websites, APIs, and servers are online and working. When they're not, we tell you about it via email, SMS, Slack, or webhooks. We do our best to make this reliable, but we're not perfect — no monitoring service is.
Your account
- You need to be at least 18 to use nark
- Keep your login details secure — we're not responsible if someone else accesses your account because you shared your password
- Use a real email address so we can actually reach you
- One account per person or company (don't create multiple free accounts to bypass limits)
What you can't do
Don't be a jerk. Specifically:
- Don't use nark to monitor things you don't own or have permission to monitor
- Don't try to break, hack, or overload the service
- Don't use nark as part of any attack on other services (DDoS amplification, etc.)
- Don't resell the service without our permission
- Don't use it for anything illegal
Payment and refunds
- Free tier is free. Paid tiers cost money. Prices are on our website.
- We bill monthly or yearly depending on what you chose
- If you cancel, you keep access until the end of your billing period
- We don't do refunds as a rule, but if something went genuinely wrong, email us and we'll sort it out
- We might change prices, but we'll give you 30 days notice
Uptime and reliability
We work hard to keep nark running, but we can't guarantee 100% uptime. Sometimes things break. We might have scheduled maintenance. Your internet might go down. If nark fails to alert you about an outage and it costs you money, we're sorry, but we're not liable for that. You should have your own backup monitoring if uptime is truly critical for your business.
Your data

- We need to store and process it to provide the service
- You can export or delete your data anytime

Termination
You can cancel anytime from your account settings. We can also terminate your account if you violate these terms or do something that puts the service at risk. If we shut down the service entirely (we hope we won't), we'll give you as much notice as possible and help you export your data.
Liability
To the maximum extent permitted by Australian law: we provide nark "as is" without warranties. We're not liable for any indirect, incidental, or consequential damages. Our total liability is limited to what you've paid us in the last 12 months. This isn't us being difficult — it's just how software services work.
Changes to these terms
We might update these terms occasionally. If we make significant changes, we'll email you. Continuing to use nark after changes means you accept the new terms.
Legal bits
- These terms are governed by the laws of New South Wales, Australia
- Any disputes go to the courts of NSW
- If any part of these terms is unenforceable, the rest still applies
